PRINCIPLES OF PRIVATE LAW
Learning outcomes of the course unit
The course is designed to provide a comprehensive introduction to Italian private law.
The course is essential for all the other courses, apart from courses of sectors IUS/19 (Storia del diritto italiano), IUS/20 (Filosofia del diritto) and SECS/P01 (Economia politica).
Course contents summary
1. Nature of law: concept and classifications. Legal rule and legal system. Sources of private law. 2. Legal relations. 3. Legal subjects. Capacity to have rights and capacity to exercise rights. Natural person and corporate person. 4. Property, the so called "diritti reali", possession. 5. Law of obligations: sources of obligations. Classification of obligations. Performance and other forms of extinction of obligations. Law of contract. Main contracts. 6. Law of torts. 7. Protection of rights. 8. Prescription. 9. Registration.10. Basics of corporate law.
Is it necessary to design an updated manual. We recommend:
Istituzioni di diritto privato, a cura di M. Bessone, Torino, Giappichelli (latest edition): only chapters from I to XIV (Introduction and First part) and from XXIX to XCIII (from Fourth part to Eleventh part including), apart from part II of chapter LXXVIII ("Il lavoro nell'impresa") (950 pages).
Therefore, the program of study should be excluded, regardless of the Manual adopted, the following topics: family relationships, successions, donations, labour law.
As for business, society and bankruptcy procedures, they are sufficient the main concepts .

Assessment methods and criteria
Oral exam in respect of the whole programme. At least three questions will be put.
